By using MBGirl.com, you confirm that you have read, understood, and agree to these Terms. 1. Nature of the Service MBGirl.com is an online conversational game for adults in which users interact with virtual fictional characters, develop in-game relationships, progress through stories, and use other game features. Some parts of the Game may use pre-written dialogue and game mechanics, while other features may use generative artificial intelligence. All characters appearing on MBGirl.com are fictional. They are not real people. MBGirl.com is not a dating service and does not provide users with the ability to establish real relationships with the characters depicted in the Game. Images, illustrations, videos, voices, profiles, personalities, messages, and other character-related content may be created, generated, or modified using artificial intelligence or other digital technologies. 3. Age Restriction – 18+ Only MBGirl.com is intended exclusively for persons aged 18 or over. By registering for or using the Service, the user confirms that they are at least 18 years old. Persons under the age of 18 are not permitted to use MBGirl.com. If we discover or reasonably suspect that the Service is being used by a person under the age of 18, we may suspend or terminate the relevant account without prior notice. 4. User Accounts Certain features of MBGirl.com may require the creation of a user account. Users are responsible for: providing accurate information during registration, maintaining the security of their account, protecting their login credentials, all activity carried out through their account. Users must not allow anyone under the age of 18 to use their account. If a user believes that their account has been accessed or used without authorization, they should contact us without undue delay. 5. FREE and PREMIUM Versions MBGirl.com may be available in both a free (FREE) and paid (PREMIUM) version. The FREE version may include, for example: limited access to certain features, limited game content, advertising, limitations on conversations, other restrictions specified within the Game. The PREMIUM version may include, for example: enhanced conversations, artificial intelligence features, additional gameplay options, enhanced character memory, special or additional content, reduced or removed advertising, other benefits specified at the time of purchase. The specific content and functionality of the FREE and PREMIUM versions may change as the Game develops. 6. Artificial Intelligence Certain features of MBGirl.com may use generative artificial intelligence. Users acknowledge that responses generated by artificial intelligence are created automatically and may sometimes be: inaccurate, unexpected, illogical, repetitive, inappropriate for a particular situation, factually incorrect. AI-generated responses form part of a fictional entertainment experience and must not be regarded as professional medical, psychological, legal, financial, or other specialist advice. The Service Provider does not guarantee any particular response, reaction, behavior, or outcome from an AI-powered character. 7. Fictional Relationships and Character Interaction A core feature of MBGirl.com is the creation and development of fictional relationships between the player and virtual characters. A virtual character may, for example: respond positively or negatively, flirt with the player, reject the player, change their attitude, react according to previous conversations, simulate emotions, initiate in-game communication, respond according to their fictional personality. All such behavior is part of the Game. Virtual characters do not have real emotions, consciousness, personal relationships with users, or independent intentions. Interactions with characters should therefore always be understood as part of a fictional entertainment experience. 8. Game Progress, Hearts, Points, and Other Game Elements MBGirl.com may use various game mechanics, including: hearts, points, experience, levels, relationship scores, gifts, virtual items, rewards, achievements, unlockable content. These elements have meaning only within MBGirl.com. Unless expressly stated otherwise, they have no real-world monetary value, are not electronic money, cryptocurrency, securities, or financial instruments, and cannot be exchanged for real money. 9. Virtual Items and Digital Content MBGirl.com may allow users to purchase or obtain virtual items, gifts, in-game currency, bonuses, or other digital content. By purchasing a virtual item, the user receives a limited right to use that item within the Game in accordance with these Terms and the relevant game rules. The user does not acquire ownership of the underlying software, graphics, characters, intellectual property, or other content associated with a virtual item. Virtual items may not be sold, transferred, exchanged, or commercially exploited outside MBGirl.com without our prior permission. 10. Prices and Payments The prices of paid services are displayed before an order is completed. Before confirming a purchase, users will be informed of relevant information including: the price, the content or nature of the paid service, the duration of any subscription, where applicable, whether the subscription renews automatically, where applicable, other material conditions relating to the purchase. Payments may be processed by an external payment service provider. Additional terms of the relevant payment provider may apply to payment processing. 11. Subscriptions Certain PREMIUM services may be offered on a subscription basis. If a subscription automatically renews, this will be disclosed before the user purchases the subscription. Users may cancel a subscription using the method available in their account or according to the instructions provided at the time of purchase. Cancellation generally prevents the subscription from renewing for another billing period. Unless otherwise stated or required by applicable law, access to already-paid subscription features may remain available until the end of the current paid subscription period. 12. Withdrawal Rights and Digital Content Consumer rights are governed by applicable law. Where digital content or a digital service is supplied immediately after payment, commencement of performance may require the user's express consent to begin providing the service before the expiry of the statutory withdrawal period and acknowledgment that, under the conditions specified by applicable law, the user may thereby lose their right of withdrawal. Where such consent or acknowledgment is legally required, it will be requested separately during the purchase process. Nothing in these Terms limits or excludes any mandatory consumer rights that cannot lawfully be waived or restricted. 13. Advertising and Advertising Rewards The FREE version of MBGirl.com may contain advertising. The Game may allow users to receive an in-game benefit or reward, for example, in exchange for: watching an advertising video, interacting with an advertisement, completing another advertising offer where such functionality is available. The specific reward and the conditions for obtaining it will be displayed within the Game. The display of an advertisement or advertising offer does not necessarily constitute an endorsement or recommendation of the advertised product or service by the operator of MBGirl.com. 14. User Conduct When using MBGirl.com, users must not: violate applicable laws or regulations, attempt to compromise or circumvent the security of the Service, gain or attempt to gain unauthorized access to another user's account, use automated systems to obtain content without authorization, scrape the Service without the Service Provider's permission, manipulate game mechanics, deliberately exploit bugs or vulnerabilities, circumvent payment mechanisms, copy or distribute MBGirl.com content without authorization, use the Service in a manner that may damage the Service or interfere with other users. Users must not use the Service to create, request, distribute, or otherwise engage with content where doing so would violate applicable law. 15. Prohibited Content Involving Minors It is strictly prohibited to use MBGirl.com to create, simulate, request, distribute, or otherwise engage with sexual or otherwise inappropriate content involving minors. This prohibition also applies to fictional, simulated, or AI-generated characters represented or presented as minors. Violation of this rule may result in immediate account suspension or termination and any further action required under applicable law. 16. Intellectual Property Unless otherwise stated, content made available through MBGirl.com, including: the name and brand, graphical elements, design, source code, game systems and mechanics, texts, dialogue, stories, images and illustrations, videos, characters, databases, other content is protected by applicable intellectual property rights. Users receive only a limited, non-exclusive, non-transferable right to use the Service for personal purposes in accordance with these Terms. Unless permitted by law or expressly authorized by the Service Provider, users may not copy, sell, publish, distribute, reproduce, modify, or commercially exploit content from the Service. 17. Availability of the Service We aim to provide reliable access to MBGirl.com but cannot guarantee that the Service will be available continuously, uninterrupted, or without errors. The Service may be temporarily unavailable due to circumstances including: maintenance, updates, technical failures, outages affecting third-party providers, security incidents, circumstances outside our reasonable control. MBGirl.com is an evolving Service, and individual features may be added, modified, replaced, or discontinued over time. 18. Changes to the Game and Its Features The Service Provider may update and develop MBGirl.com over time. Changes may include, in particular: user interface and graphical design, gameplay rules, characters, dialogue, scoring systems, in-game economy, AI functionality, FREE and PREMIUM features, virtual items, advertising features. Where paid services are affected, users' mandatory rights under applicable law will be respected. 19. Account Suspension and Termination Users may terminate their account using functionality available within their user account or by contacting the Service Provider. The Service Provider may temporarily suspend or terminate an account, particularly in cases involving: serious or repeated violations of these Terms, fraudulent activity, misuse of the Service, attempts to gain unauthorized access, circumvention of payment mechanisms, use of the Service by a person under the age of 18, other conduct that threatens MBGirl.com, its systems, or its users. Where circumstances permit and immediate action is not necessary, the user may be notified before their account is terminated. Termination of an account may result in loss of game progress, conversation history, virtual items, rewards, and other information associated with the account, subject to applicable law. 20. Limitation of Liability MBGirl.com is primarily an entertainment service. To the maximum extent permitted by applicable law, the Service Provider is not responsible for losses or damage resulting from circumstances outside its reasonable control, the actions of the user, or use of the Service contrary to these Terms. In particular, the Service Provider does not guarantee: any particular game outcome, any particular response from a virtual character, the factual accuracy of AI-generated responses, continuous availability of all features. Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited under applicable law. Nothing in these Terms affects mandatory consumer rights. 21. Privacy and Personal Data The processing of personal data is governed by the separate MBGirl.com Privacy Policy. The use of cookies and similar technologies may also be governed by separate cookie information and the user's cookie consent preferences. 22. Third-Party Links and Services MBGirl.com may contain links to third-party websites, services, payment systems, advertisements, or offers. Such services are operated by independent third parties and may be subject to their own terms of service and privacy policies. The Service Provider is not responsible for third-party content or services except to the extent that such responsibility is required by applicable law. 23. Changes to These Terms We may reasonably update these Terms from time to time, particularly in connection with: development of MBGirl.com, introduction of new features, changes to payment or PREMIUM services, technological changes, changes in applicable law or regulatory requirements. Governing Law These Terms and legal relationships arising in connection with MBGirl.com are governed by the laws of the Czech Republic, without prejudice to any mandatory consumer protection rights that may apply to users under the laws of their country of residence. Any disputes will be resolved by the competent courts in accordance with applicable law. Where the user is a consumer, nothing in this section deprives the user of any protection granted by mandatory provisions of applicable consumer law. 25. Severability If any provision of these Terms is found to be invalid, ineffective, or unenforceable, this will not affect the validity or enforceability of the remaining provisions unless applicable law provides otherwise. 26.
